These Terms of Use (“Terms”) govern your access to and use of the Site, our newsletters, quizzes, and any content, features, or services we provide (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

To the fullest extent permitted by law, Upgrade Your Stack and its owners, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim will not exceed one hundred dollars (USD $100).
8) Your responsibilities and acceptable use
- Violate any laws or regulations.
- Copy, scrape, crawl, index, or archive the Site in bulk without written permission.
- Reverse engineer or interfere with the Site’s operation or security.
- Use the Services to distribute malware, unsolicited marketing, or spam.
- Misrepresent your identity or affiliation.
9) Accounts, emails, and submissions
If you subscribe to our newsletter or submit forms, you agree to provide accurate information and to receive communications related to your request. You can unsubscribe from marketing emails at any time using the link in each email.
If you submit content to us (comments, feedback, testimonials, requests), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, translate, and display that content for the purpose of operating and improving the Services, and for marketing the Site. Do not submit confidential or proprietary information.
10) Intellectual property
All content on the Services, including text, graphics, logos, icons, images, videos, downloads, and compilations, is owned by Upgrade Your Stack or our licensors and is protected by copyright, trademark, and other laws. You may use the content for personal, noncommercial purposes only. Any other use requires prior written permission.
“Upgrade Your Stack” and related marks are trademarks or service marks of their respective owners. All third-party names and logos are the property of their respective owners and used for identification only.
11) AI-assisted content
Some content may be created or assisted by artificial intelligence. AI-assisted content can contain errors or omissions. You should independently verify information before relying on it.
12) Third-party sites and services
The Services may link to or integrate with third-party websites, tools, embeds, videos, forms, analytics, or ecommerce providers. We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
13) Paid offerings, trials, and refunds
If we offer paid services, courses, or digital products, additional terms will be shown at checkout or in a separate agreement. Unless those terms say otherwise, all fees are due at purchase and are nonrefundable.

Your use of the Services is also governed by our Privacy Policy, which explains what data we collect and how we use it. By using the Services, you consent to the practices described there.
15) DMCA and intellectual property complaints
If you believe that content on UpgradeYourStack.com infringes your copyright, contact us with:

- A description of the copyrighted work
- The URL of the allegedly infringing material
- A statement that you have a good-faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on the owner’s behalf

16) Termination and suspension
We may suspend or terminate your access to the Services at any time for any reason, including for a suspected breach of these Terms or to comply with law or requests by authorities.
17) Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state or federal courts located in Los Angeles County, California, for any dispute arising from or relating to the Services or these Terms.
18) Export controls
You agree to comply with all applicable U.S. and international export control laws and sanctions when using the Services.
19) Force majeure
We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, labor disputes, internet or utility failures, or actions by third parties.
20) Severability, assignment, and waiver
If any part of these Terms is found unenforceable, the rest remains in effect. You may not assign these Terms without our written consent. Our failure to enforce a provision is not a waiver of our right to do so later.
21) Entire agreement
These Terms, together with any policies or terms referenced here or posted on the Site, make up the entire agreement between you and Upgrade Your Stack regarding the Services.
